Amber Specialty Pharmacy Online Terms of Service
Pharmacy Account Registration
I desire to download my electronic protected health information (ePHI), such as information about my prescription medications, from Amber Specialty Pharmacy onto my mobile device or computer. I authorize Amber Specialty Pharmacy to transmit my ePHI onto my mobile device or computer. I understand that my ePHI is encrypted as it travels from Amber Specialty Pharmacy to my mobile device or computer. However, I understand that once my ePHI is downloaded onto my mobile device or computer, I am solely responsible for keeping such information confidential. I understand and acknowledge that there is a risk that my mobile device or computer may be stolen or accessed by an unauthorized source, and that, consequently, any ePHI that I downloaded onto my mobile device or computer may be accessed by said unauthorized source. I accept full responsibility for protecting the security of my mobile device or computer from theft or other unauthorized access. I release Amber Specialty Pharmacy from any and all liability related to the use or access of my ePHI that I download from Amber Specialty Pharmacy onto my mobile device or computer.
PILL REMINDER FUNCTION
By using the pill reminder function of the Amber Specialty Pharmacy smartphone application (app), the user agrees to the following:
The pill reminder function is intended only as a tool to remind a patient when to take their medications. Effective operation of the pill reminder function is exclusively dependent on inputted drug information as provided by the patient and/or authorized caregiver. In addition, the pill reminder function, at times, may not work properly due to malfunctions of network or phone lines, mobile devices, computer equipment or systems, servers, software, email providers, internet traffic or bandwidth, and other situations that occur outside the reasonable purview of Amber Specialty Pharmacy’s responsibility. We are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, or unauthorized access to, or alteration of, any pill reminder function caused by a third party or any user
The pill reminder function is intended to be utilized only as one component of any medication adherence approach as designated by the patient and/or patient medical provider and/or caregivers. The patient should not rely solely on this function for taking medications properly.
The pill reminder function is not a substitute for the advice provided by a physician or other medical professional. FURTHERMORE, THE AMBER SPECIALTY PHARMACY APP DOES NOT OFFER MEDICAL ADVICE AND NOTHING CONTAINED THEREIN SHOULD BE CONSTRUED AS PROFESSIONAL ADVICE FOR MEDICAL DIAGNOSIS OR TREATMENT. The patient should not use the pill reminder function to determine which medications to take or to diagnose or treat any health problem. Use of the pill reminder function or any other part of the Amber Specialty Pharmacy App does not replace medical consultations with qualified health or medical professionals.
Ultimately, it is the patient’s responsibility to take medications as prescribed. Amber Specialty Pharmacy is not liable for any injury that may occur as a result of the use of the pill reminder function.
DISCLAIMER OF WARRANTIES
THE USER EXPLICITLY AGREES THAT THE USE OF THE APP, INCLUDING WITHOUT LIMITATION THE PILL REMINDER FUNCTION, IS AT THE USER’S SOLE RISK. BOTH THE APP AND THE PILL REMINDER FUNCTION ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, NON-INFRINGEMENT, TITLE, OPERABILITY, CONDITION, QUIET ENJOYMENT, VALUE, ACCURACY OF DATA, AND SYSTEM INTEGRATION.
Amber Specialty Pharmacy offers access to information via SMS (Short Message Service) and MMS (Multimedia Message Service) text alerts, including refill reminders, shipping notifications, assessments, and other information regarding the services that Amber Specialty Pharmacy offers and provides to enrolled patients. By using or enrolling in Amber Specialty Pharmacy text message services, the user (i) certifies that the user is at least eighteen (18) years old and (ii) agrees to these terms and conditions, which become effective upon enrollment.
To enroll in Amber Specialty Pharmacy text message services, the user must provide their own mobile phone number with an area code within the 50 United States or the District of Columbia. Users may be asked to verify their mobile phone number before the service will start. This requires responding to a text alert sent to the mobile phone confirming enrollment in the text message services. Following enrollment, the frequency of text messages a user receives from Amber Specialty Pharmacy will vary based on the text message services, the number of Amber Specialty Pharmacy text message services in which the user is enrolled, and the frequency of use of Amber Specialty Pharmacy’s mobile app.
The user acknowledges that text messages will be sent to the mobile phone number provided to Amber Specialty Pharmacy. Depending on the text message services in which the user enrolls, some text messages from Amber Specialty Pharmacy may include limited personal information, and whoever has access to the mobile phone or carrier account associated with the enrolled mobile phone number will also be able to see this information.
Amber Specialty Pharmacy does not impose a separate charge for text messages. However, the user’s mobile carrier’s message and data rates will apply, and the user is responsible for all message and data charges incurred. User should contact their mobile service provider about such charges. The following carriers are supported: AT&T, Alltel, Sprint, T-Mobile, and Verizon Wireless.
Users may opt out of a specific Amber Specialty Pharmacy text messaging service at any time by texting STOP to the number from which they are receiving text alerts. This will only opt the user out of all text message services associated with the enrolled number. No additional text messages will be sent unless the user re-activates their enrollment in the Amber Specialty Pharmacy text message service. Liability. User acknowledges that the Amber Specialty Pharmacy text message services are provided on an “as is” and “as available” basis and that we do not make any warranty or representation as to the availability, usability, or fitness for a particular purpose. The Amber Specialty Pharmacy text message services may not be available in all areas at all times and may not continue to work in the event of product, software, coverage, or other service issues or changes made by a wireless carrier. We do not warrant that any information provided in our text message services is accurate, complete, reliable, current, or error-free. We exclude all other implied terms and warranties, whether statutory or otherwise, relating to the Amber Specialty Pharmacy text message services. To the fullest extent permitted by applicable laws, we will not be liable for any claims, losses, demands, or damages of any kind whatsoever, with respect to these terms and conditions. This includes the use of the Amber Specialty Pharmacy text message services, including, without limitation, direct, indirect, incidental, or consequential losses or damages, whether it be in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, loss or corruption of data and any other commercial or economic loss of any kind).
Amber Specialty Pharmacy Mobile App
With respect to the Amber Specialty Pharmacy Mobile App, users can stop all collection of information via the Amber Specialty Pharmacy Mobile App by uninstalling the app. Also, the user may be able to exercise specific privacy choices, such as enabling or disabling certain features (e.g., location-based services, push notifications, accessing calendar/contacts/photos, etc.), by adjusting the permissions on the enrolled mobile device and/or the app’s settings. There are a variety of tracking technologies that may be included in mobile applications. These are not browser-based like cookies and cannot be controlled by browser settings. Some use device identifiers, or other identifiers such as “Ad IDs”, to associate app user activity to a particular app and track user activity across apps and/or devices. Some mobile app-related tracking technologies can only be disabled by uninstalling the app. To uninstall an app, follow the instructions from for respective operating system or device. Apple and Google mobile devices have settings that may allow a user to limit certain types of tracking.
Push Notifications. With user consent, we may send push notifications to the enrolled mobile device. Push notifications can be deactivated at any time by changing the notification settings on the enrolled mobile device.
